Can American Citizens Buy Property in Switzerland?

What US citizens need to know about buying property in Switzerland.

American citizens can buy property in Switzerland, but they are subject to Lex Koller restrictions unless they are resident in Switzerland with a valid permit. For non-resident US buyers, the options are limited to Foreign Buyer Eligible holiday homes in designated tourist municipalities.

The position for US nationals

The United States does not have a bilateral agreement with Switzerland that grants US citizens preferential property purchase rights. American nationals are therefore treated as third-country nationals under Lex Koller — the same framework that applies to UK, Middle Eastern and other non-EU buyers.

Non-resident US nationals can purchase a holiday home in a designated tourist municipality such as Montreux, subject to cantonal authorisation and within the annual quota. The property must be Foreign Buyer Eligible and must be used exclusively as a private holiday home.

US nationals resident in Switzerland

American nationals who are legally resident in Switzerland — holding a B or C permit — have more extensive purchase rights. B permit holders can purchase a primary residence. C permit holders (after ten years of continuous residence) can purchase any property type without restriction.

Many US nationals working in Switzerland for multinational companies or international organisations hold B permits and can therefore purchase the property they live in without Lex Koller authorisation.

FATCA and financial considerations

US nationals purchasing property in Switzerland should be aware of their US tax reporting obligations. The Foreign Account Tax Compliance Act (FATCA) requires US persons to report foreign financial assets, and a Swiss property purchase may trigger reporting requirements. US buyers should consult a tax adviser familiar with both Swiss and US tax law before completing a purchase.

Swiss banks may also be more cautious about lending to US nationals due to FATCA compliance requirements. Some Swiss banks do not offer mortgages to US persons. Buyers should confirm financing options early in the process.
